General Terms and Conditions of Sale “Azienda agricola Lucia Vallillo”
These General Terms and Conditions of Sale govern the offer of the online purchasing service for items and products relating to the Food sector and related products by “Azienda agricola Lucia Vallillo” through our website http://stage.vallillo.it (hereinafter the “Site”).
All contractual relationships between “Azienda agricola Lucia Vallillo” and the customer are governed by these General Terms and Conditions of Sale, which form an integral and substantial part of every offer, order and order confirmation for the products sold on the site.
For anything not expressly regulated in these General Terms and Conditions of Sale, reference is made to the provisions of Legislative Decree No. 206 of 6 September 2005 (the “Consumer Code”) and subsequent amendments, and to Legislative Decree No. 70 of 9 April 2003 and subsequent amendments, as well as to the provisions of the Italian Civil Code.

2. Commercial Policy
2.1 “Azienda agricola Lucia Vallillo”, through the Site, offers for sale products relating to the Food sector and related products.
2.2 The sale of products relating to the Food sector and related products is aimed exclusively at “consumers” aged over 18 (eighteen) years.
“Consumer” means any natural person acting on the Site for purposes unrelated to their professional, commercial or business activity.
2.3 The essential characteristics of products relating to the Food sector and related products are presented with specific descriptions, visible directly on the Site.
3. Sales Contract and Service Delivery Methods
3.1 These General Terms and Conditions of Sale exclusively govern the provision of the Food and related products service through the Site.
3.2 These General Terms and Conditions of Sale do not, however, govern the provision of services or the sale of products by parties other than “Azienda agricola Lucia Vallillo”, which may be referenced on the Site through hyperlinks or banners. “Azienda agricola Lucia Vallillo” is not responsible for the provision of services and/or products, nor for the conclusion of any contract between you and third parties other than “Azienda agricola Lucia Vallillo”. 3.3 You may proceed to purchase products relating to the Food sector and related products by operating directly on the Site. At the end of the product selection process, you will be shown a screen for submitting the order with an indication of all the data entered, which you are required to check for accuracy. Once the selection of products relating to the Food sector and related products has been completed, in order to carry out the purchase, you will also be invited to (i) register (free of charge) on the Site, providing the requested data, or (ii) log in, if already registered, or (iii) provide your details in order to complete the order and allow the contract to be finalized.
3.4 To proceed with the purchase of one or more products relating to the Food sector and related products, it is necessary to fill in the purchase order directly on the Site following the relevant instructions (hereinafter the “Purchase Order”).
The Purchase Order contains a summary of the main commercial conditions, including the price, means of payment and delivery methods, as well as information on the main characteristics of the products ordered and a reference to the General Terms and Conditions of Sale.
3.5 Before submitting the Purchase Order, it will be necessary to carefully read these General Terms and Conditions of Sale.
3.6 Azienda agricola Lucia Vallillo reserves the right, at its sole discretion, not to accept, even partially, product orders. Such refusal does not give rise to any right, compensation and/or reimbursement of any kind and for any reason against Azienda agricola Lucia Vallillo.
3.7 In order for Azienda agricola Lucia Vallillo to proceed with the shipment of the products, it is necessary for you to pay the amount for the purchase of the products (hereinafter the “Price”) in the manner indicated in Article 6 below (“Payments”).
3.8 Following payment of the Price, you will be assigned an order number that must be used for any further communication with Azienda agricola Lucia Vallillo regarding the Purchase Order (hereinafter the “Order Number”).
4. Prices
4.1 All sale Prices of the products present on the Site next to each individual item are expressed in Euro currency and include VAT (where applicable) and any indirect taxes (where applicable), while they do not include shipping costs, which are calculated before the Order Confirmation sent to you and which you undertake to pay to Azienda agricola Lucia Vallillo, in addition to the Price indicated on the Site.
4.2 The Prices of individual products, as published from time to time, cancel and replace any previous Prices. In any case, the Prices applied are those indicated on the Site at the time of the Purchase Order and reiterated within the latter.
5. Payments
5.1 Payments may be made by PayPal made out to Azienda agricola Lucia Vallillo
5.2 In the case of payment by PayPal, it will also be possible to pay by credit card using exclusively the encrypted PayPal circuit.
5.3 At no point during the purchase process is Azienda agricola Lucia Vallillo able to access information relating to credit cards and prepaid cards, which you transmit via a secure connection directly to the website of the Banking Institution that manages the transaction, without third parties being able to access it. No electronic archive relating to the payment instruments of the Price is in any way accessible to Azienda agricola Lucia Vallillo, and therefore Azienda agricola Lucia Vallillo may in no case be held responsible for any fraudulent and unlawful use of credit cards by third parties when paying for purchased products.
5.4 Following payment of the Price, and in any case within 5 working days from the date on which Azienda agricola Lucia Vallillo became aware of the crediting of the Price to its bank account (in the case of payment by PayPal or Credit Cards on the PayPal circuit), Azienda agricola Lucia Vallillo will inform you of receipt of the Price via an e-mail communication, which will also inform you of the delivery times of the product, which may in no case exceed 15 (fifteen) working days from the Purchase Order.
5.5 In the event that, before the Order Confirmation is sent by Azienda agricola Lucia Vallillo, you request in writing (by e-mail to info@vallillo.it) the cancellation of the Purchase Order, Azienda agricola Lucia Vallillo will request PayPal to cancel the transaction. Once the request to cancel the transaction has been made, Azienda agricola Lucia Vallillo may in no case be held responsible for any expenses, costs or damages, direct or indirect, caused by the delay of the transaction itself.
6. Shipping and Delivery
6.1 Azienda agricola Lucia Vallillo will have the ordered products delivered to the address specified at the time of the Purchase Order, in the manner indicated below.
6.2 For the delivery of the products, you must provide all necessary information, including the shipping address and telephone number of the person to whom the product is to be delivered, if different from the person placing the order. Delivery will be made to the recipient indicated on the waybill.
6.3 The ordered products will be delivered in packaging suitable to guarantee their integrity during transport. Shipment is carried out by courier (hereinafter the “Carrier”) with delivery to the address indicated directly in the order.
6.4 Upon receipt of the products, you are required to check:
(i) that the quantity of the products ordered corresponds to what is indicated in the transport document;
(ii) that the packaging is intact, not damaged or, in any case, altered even in the closing materials.
Once the Carrier’s transport document has been signed, no complaint regarding the characteristics of the delivered goods may be raised against Azienda agricola Lucia Vallillo.
6.5 Should the Carrier be unable to deliver the products due to the physical absence of the recipient or their appointed delegate at the indicated address, or due to an incorrect address, the Carrier will contact the recipient by telephone in the following days (if possible), in order to proceed with a second delivery attempt and complete delivery of the product.
After 5 (five) days without the recipient making themselves available to collect the products, the products will be returned to Azienda agricola Lucia Vallillo and all expenses, direct and indirect, will be entirely borne by the person placing the order, and Azienda agricola Lucia Vallillo will retain payment for the products as a penalty, without prejudice to the right to any further damages suffered.
6.6 Should the package delivered by the Carrier be visibly damaged and broken, please reject the shipment and return it to the sender. In this case Azienda agricola Lucia Vallillo will take care of recovering the shipment and arranging a new dispatch.
If the shipment consists of several packages and not all of them are damaged, please reject only the damaged package by returning it to the sender, signing the courier’s waybill “With Reservation”. Azienda agricola Lucia Vallillo will arrange for the recovery of the damaged package and its replacement.
7. Right of Withdrawal for “consumers”
7.1 The “consumer” customer (as defined in Article 2.2) has the right to withdraw without any penalty and without the need to specify the reason, within 14 working days from the date of receipt of the Products.
7.2 The customer may exercise the right of withdrawal by sending (by e-mail) a withdrawal request to the following email address reclami@vallillo.it with the subject: withdrawal request.
7.3 In the event of exercise of the right of withdrawal in accordance with the above, Azienda agricola Lucia Vallillo is required to refund the Price within 30 days from the date on which it became aware of the exercise of the right of withdrawal.
7.4 The exercise of the right of withdrawal by the customer is in any case subject to the following conditions:
- (a) the right of withdrawal applies to the Product purchased in its entirety and it will not be possible to return only certain parts of the Products, such as, by way of example, its accessories;
- (b) the right of withdrawal does not apply to Products that have been sealed once they have been opened;
- (c) the purchased Product must be intact and returned in its original packaging, complete in all its parts;
- (d) the Product must be returned in normal condition, having been kept and, if applicable, used with normal care; Products that are used, malfunctioning, or show signs of damage or dirt, and which can therefore no longer be considered intact, will not be accepted;
- (e) shipping costs relating to the return of the Product will be borne by the Customer;
- (f) the shipment, until confirmation of receipt at our warehouse, is entirely the responsibility of the customer.
- (a) the absence of the external packaging and/or the original internal packaging;
- (b) the absence of integral elements of the Product;
- (c) damage to the Product;
- (d) the absence of the invoice.
